01 Parties
SS8 Productions, Anuj Dhakal, carrying on business as SS8 Productions, Terrace, BC. [email protected] ("SS8"). You are the client named on your agreement ("you"). Your agreement shows its date and reference number.
02 Services & Deliverables
SS8 provides the services and deliverables in Schedule A (package, session length, edited count, delivery format). Schedule A lists what is included and what is not for your package. Anything not listed there, for example RAW files, raw footage, extra hours, re-edits beyond section 4, added crew, is not included unless SS8 and you agree it and its price in writing first.
Property photos: you are responsible for how the photos are used and described in your listing.
Team and group sessions: anyone who misses the session day can be added later at the per-person price quoted for your package.
03 Editing & Tools
SS8 chooses and edits your photos and video in its own style, including colour, light, backgrounds and skies. SS8 may use the built-in features of the editing and delivery tools it works with, and some of those features may be automated or AI-assisted. SS8 reviews every delivered image and is answerable to you for the final work. SS8 makes no representation or warranty about how third-party software itself operates, and is not liable for a fault, outage or error that starts in third-party software, except where SS8 failed to use reasonable care in choosing, checking or backing up its work. If something does not feel right, tell SS8 within 7 days of delivery and SS8 will adjust it under section 4. Nothing in this section limits your rights under BC consumer law.
04 Changes & Re-edits
Every package includes one round of small changes, asked for in one message within 7 days of delivery. Small changes are about 1 hour of work or less, for example trimming, fixing a caption or a typo, adjusting colour or sound, or swapping a photo for another from the same shoot.
A re-edit is anything more, and SS8 quotes it before starting: changing the story or script after filming, removing a topic, a person or a claim, adding new footage or doing a new shoot, making a second version or a different length, or any change asked for after 7 days. Re-edits are charged at $85 per hour, in half-hour blocks, and only start after you agree the quote.
Your delivery is accepted if no change request reaches SS8 within 7 days of delivery. SS8 will always correct its own errors, such as a wrong file, a missing image or a technical fault, at no charge. This section does not affect your rights under BC consumer law.
05 Your Content & Claims
You confirm that you have the right to give SS8 the script, words, logos, music, titles, credentials and other material you supply, including any title or claim controlled by a regulator, an employer or a professional body, and that this material does not break anyone's rights or any law. If a regulator, employer or anyone else later objects to your content, changes are a re-edit under section 4. If a third party makes a claim against SS8 because the material you supplied breaks this confirmation, you will pay SS8's reasonable and documented costs of dealing with that claim, including reasonable legal fees. SS8 will tell you promptly and give you a fair chance to resolve the claim first. This does not apply to anything caused by SS8's own error or edits, or to claims that arise from the way SS8 itself chose to use the work.
06 Video
Before filming, you approve the final script or talking points in writing (email or portal is fine). SS8 films and edits to that approved script. Your package includes the formats listed in Schedule A; making the same edit in another shape, for example vertical 9:16, is included where listed and is not a new version. Background music comes from SS8's licensed library and is licensed for this video only. Raw footage is not included.
07 Aerial Photos
SS8 flies a small drone under 250 g and follows Transport Canada rules. SS8 does not fly in controlled or restricted airspace, near airports, at emergency scenes, or over crowds, and does not fly at, or within 30 m of, an advertised public event. SS8 respects the privacy of people near the flight area and trespass laws, and does not fly where a rule or the property owner forbids it. You confirm that you own the property or have the owner's permission for SS8 to fly over and photograph it, or you will tell SS8 who must give it. SS8 may delay, move or stop a flight for wind, rain, airspace limits, people below or any safety reason, at no charge, as in section 11.
08 Price & Tax
The total price in Schedule A is what you pay for the services listed. Costs that depend on your location or choices, such as travel past 40 km each way, ferries, overnight stays, rush delivery and extra time, are shown on the booking page and quoted to you in writing before your booking is confirmed. SS8 does not add any charge you have not agreed to. No tax is added to the price unless later required by law, with written notice first.
09 Deposit, Cancellation & Refunds
A deposit confirms your booking and counts toward your total. It is 30%, 50% for weddings and Diamond packages, and the full price for property packages, as shown on your booking page. Reserving your date turns away other work. SS8 keeps only an amount that reflects that real cost, as set out below. SS8 does not keep money as a penalty. If a court finds that any amount SS8 keeps is more than SS8's reasonable loss, SS8 will refund the difference. These are the terms you can always count on:
- 48-hour change of mind: if you cancel in writing within 48 hours after paying the deposit, SS8 refunds the deposit minus the payment processing fee charged on your payment. Payment providers do not return their fee when a payment is refunded; the exact amount is shown on your refund receipt. If your session is less than 7 days away when you pay, this 48-hour refund does not apply.
- After those 48 hours: the deposit is not refunded. It covers the date held and the work done before the shoot: planning, scheduling and turning away other bookings.
- Moving your date: for any reason other than weather, you can move your session once, free, with at least 7 days notice, to a new date within 6 months, as long as SS8 has not started work for it (no travel booked, no location scouting, no planning call held). Your deposit carries over. After that one move, or with less notice, the cancellation terms in this section apply.
- Once work has started (travel booked, location scouted or a planning call held) or your session is less than 7 days away, the deposit is kept, because that time and work cannot be recovered.
- Less than 48 hours notice before the session, or a no-show: the deposit is kept. Any amount you paid beyond the deposit is refunded minus payment processing fees.
- If you paid the full price in advance: if you cancel in writing within 48 hours after paying, and your session is 7 days or more away, SS8 refunds everything you paid minus the payment processing fee. After that, if you cancel in writing 48 hours or more before the session start, SS8 refunds the amount you paid minus 30 percent of the total price and the payment processing fee. If you cancel less than 48 hours before, or do not attend, there is no refund. SS8 may refund more at its discretion, for example when the date can be given to another client.
- If you cancel after the session: the session fee is owed. SS8 delivers the work completed so far and refunds any amount you paid for work not yet done, minus the payment processing fee.
- If BC law gives you a right to cancel and be refunded: SS8 refunds all money you paid, without deduction.
- SS8 may offer more: for example a new date, a credit, a different session or a partial refund, most often when nothing has started on SS8's side. This is decided case by case and is not guaranteed; the points above are what you can always count on.
- If SS8 cancels (section 13), you get a full refund, including processing fees, or a free reschedule, your choice.
- Refunds go back to the original payment method within 10 business days of approval.
- If you have a concern about a charge, please contact SS8 first so it can be fixed. SS8 keeps this signed agreement, your payment record and its delivery records as evidence in case of a payment dispute.
10 Balance & Payment
The balance is due before final files are released for download. Accepted: card, digital wallet, PayPal, and e-Transfer on request. Late payment: if an invoice is not paid by its due date, SS8 sends you a reminder. If it is still unpaid 10 days after the reminder, simple interest of 12 percent per year (1 percent per month, not compounded) applies from the due date on the invoice or, if none, 30 days after the invoice is sent, until it is paid. Until the final invoice is paid in full, your images are watermarked proofs only (see section 16).
11 Location, Weather & Safety
Location: SS8 does not have its own studio. Every session happens on location, at a place chosen together or one you book. Any venue, location, studio, park permit or entry fee is paid by you, directly to the venue or reimbursed to SS8 if SS8 paid it first. If a venue cancels, changes access or adds a charge, that is between you and the venue; SS8 will try a backup spot nearby if one is available.
Weather (outdoor shoots): if rain, snow or wildfire smoke makes an outdoor shoot unsafe or unworkable, SS8 moves it free of charge and your deposit carries over. SS8 can decide up to the morning of the shoot, and you can ask for a move up to 24 hours before. Weather moves do not use your one free date change. If no date works for both of us within 6 months, SS8 refunds the deposit minus the payment processing fee.
Weddings and events go ahead in any weather. SS8 agrees an indoor or covered backup with you in planning, and the space and its cost are yours to arrange. SS8 keeps shooting outside while it is safe for people and equipment, and moves to the agreed backup when it is not.
Travel is included for the first 40 km each way. Past that: $0.28 per km ($20 minimum); ferries or overnight stays at cost, quoted before your date is confirmed.
Safety and equipment: SS8 may pause or end a session early if the location, the weather or a person present makes it unsafe to keep working; work already done is delivered under these terms. If SS8's equipment is damaged by you or your guests, you cover the repair or replacement cost.
Events outside anyone's control: if illness, severe weather, wildfire, a power or travel failure, a government order, or another event outside the reasonable control of either of us stops or delays the work, the affected date is moved at no extra cost to a date that suits both of us within 6 months. If no date works, SS8 refunds what you paid for work not yet done minus the payment processing fee, and you pay for work already completed. SS8 delivers any completed work. Neither of us is in breach because of such an event. This section sets the consequences, as the Frustrated Contract Act allows.
12 Your Responsibilities
You will arrange location access and permission, any required permits, disclose known safety hazards, be ready at the agreed start time, and manage guests so the session runs safely and on schedule. A late start on your end may shorten covered time.
13 Cancellation by SS8
If SS8 must cancel for a reason within its control, SS8 gives as much notice as possible and offers a new date or a full refund of everything you paid, including any payment processing fee, your choice.
14 Equipment or Data Failure, Reshoots
Despite reasonable care and backups where practical, equipment or files can occasionally fail. If affected work cannot be recovered or redone, SS8's liability is limited to refunding the fee portion for that lost material. If a shoot needs to be redone because of SS8's mistake, SS8 reshoots it free or refunds that part, your choice. If the reason is on your side, for example a late start, a property not ready, or a changed plan or script, a new shoot is a new booking. Work already done is paid for, and SS8 may offer a reduced price for the new booking, case by case, depending on how far the work had progressed.
15 Limit of Liability
SS8 takes care to do the work well. If SS8 is at fault, SS8 is liable only for the fees you paid for the part of the work affected, plus any amount that BC law requires SS8 to pay. SS8 is not liable for indirect or consequential losses, such as lost income or lost opportunity. This section does not limit liability for death or personal injury caused by SS8, for fraud, for gross negligence or wilful misconduct, or for anything the law does not allow SS8 to limit. It does not limit any right you have under BC consumer law.
16 Copyright & Licence
Ownership. SS8 owns the copyright in all photographs and video it creates. Under the Copyright Act (Canada), the author of a work is its first owner. Nothing in this agreement transfers copyright to you. You receive only the licence below.
Before you pay in full: your images are watermarked proofs, for viewing and approving only. There is no download of clean files, and no publishing, posting, sharing or public release. Doing any of these is unlicensed use, and SS8 may claim the remedies the Copyright Act allows.
Your licence starts only when the final invoice is paid in full. From then on you have a non-exclusive, non-transferable licence, with no end date, to use the final delivered images for this purpose only: the purpose stated on your agreement (personal use for individuals, business use for businesses). You may not sell them, license them to others or use them to advertise a business unless that is the purpose stated here. If you booked as a business, your printers, agents and designers may use the images for you for that purpose. Any use beyond this purpose needs a separate written licence from SS8.
Edits you make. You may crop, resize and adjust colour for normal use. SS8 asks you not to alter the images in a way that distorts them, or to use them with a cause or product you did not tell SS8 about. SS8 keeps its right to be credited where that is reasonable.
If a payment is reversed or charged back, the licence for the work that payment covered stops until it is paid again.
People in your photos. You are responsible for telling the adults you bring that they will be photographed or filmed, and for getting a parent or guardian's agreement for anyone under 19. SS8 will not use a recognizable image of a person in advertising or on its website unless that person, or their parent or guardian, has agreed, or SS8 has checked with you first. People in the background of a larger scene are not featured. You are also responsible for permission from the owner of any place or property SS8 shoots, especially for business use of photos or video where people can be recognised.
17 Reviews & Testimonials
A "review or testimonial" is your own written words (and rating) about SS8, whether you give them to SS8 directly or post them publicly, for example on Google.
SS8 shows yours only if you say Yes. After your photos are delivered we may invite you to leave a review on Google. At that time we also ask one Yes or No question: may SS8 show your review, with your first name, on its website? You are not asked about this when you sign. No answer means No. No is always fine and changes nothing about your service.
Where it may appear: the SS8 website, social media and marketing materials. How: with your first name only (plus your town or the type of shoot) unless you agree to more. SS8 may shorten it or fix spelling, but never changes its meaning. No reward: SS8 gives no payment or discount for a review, and never asks for a good one.
You can change your mind at any time in your client portal ("Your review") or by emailing [email protected]. SS8 takes it off its website within 7 days. SS8 cannot recall printed copies or copies others have already shared. SS8 keeps a record of your choices, when you made them and any change, under BC's Personal Information Protection Act (PIPA).
18 Privacy
SS8 collects your name, contact details, payment record and session images or video to deliver the service, take payment and keep business records, under BC's Personal Information Protection Act (PIPA). SS8 uses trusted software and service providers to edit, store, deliver and process payment. They handle your files and details only to provide the service, and SS8 remains responsible for them. SS8 protects your information with reasonable security and does not sell it. To see or correct the personal information SS8 holds about you, email [email protected].
Your private gallery stays open 90 days after delivery. After that, contact SS8 and SS8 will help you get your photos back. SS8 keeps final files on its own storage on a best-effort basis, so please save your own copies. SS8 keeps business and tax records for as long as the law or the business requires, and then deletes them.
Portfolio and marketing use. Unless you tick the opt-out, SS8 may show your photos in its portfolio and marketing. To opt out, tick the box below, or tell SS8 at any time at [email protected]. SS8 removes the photos from its own website within 7 days. SS8 cannot recall printed copies or copies others have shared.
Emails. SS8 sends you emails about your booking, such as confirmations, invoices, reminders and delivery. If SS8 later sends marketing emails, it does so only with your consent, and each one has an unsubscribe link.
19 Delivery Timing
Delivery times in Schedule A count from the day after the shoot and are SS8's best estimate, not a guarantee. They pause while SS8 is waiting on you, for example for a payment, a script, a choice or feedback. SS8 will tell you if anything changes.
20 Disputes & Governing Law
Please contact SS8 first so it can try to resolve any concern. That is a request, not a requirement. Either of us may take a claim to the BC Civil Resolution Tribunal if it is within the Tribunal's limit, or to a court. This agreement is governed by the laws of British Columbia and the federal laws of Canada that apply there, and the courts of British Columbia can hear any claim not brought to the Tribunal.
21 Electronic Signatures
An electronic signature on this agreement is legally valid and binding under BC's Electronic Transactions Act. Section 11(1) says: "If there is a requirement under law for the signature of a person, that requirement is satisfied by an electronic signature."
You may sign this agreement electronically either by ticking "I agree" on the SS8 payment page when you pay, or by typing your name and ticking "I agree" in your client portal. That signature is as valid as a handwritten one. SS8 keeps a record of what you saw, when you accepted, your name, your email address and the copy SS8 sent you.
22 Your Copy & Consumer Disclosures
Before you accept, SS8 shows you the full agreement, the price, what is included, the delivery timing and the cancellation and refund terms, and you can read, save and print them. You can correct any detail or decline before you accept. Right after you accept, SS8 emails you a copy of this agreement. If you do not receive it, tell SS8 and it will be sent at once. If BC law gives you a right to cancel, for example if required information was missing, you may cancel by telling SS8 in writing and SS8 will refund all money you paid, without deduction. Nothing in this agreement takes away a right you have under the Business Practices and Consumer Protection Act.
23 Notices & What Continues
SS8 and you send notices by email to the addresses in this agreement. A notice is treated as received on the third day after it is sent, unless the other side replies sooner. Tell the other side if your email address changes. The sections on copyright and licence, payment and refunds already due, interest, limit of liability, your content and claims, privacy and disputes continue after the work is delivered.
24 Whole Agreement, Changes & Assistants
Whole agreement. This agreement, with Schedule A and the written quote or invoice SS8 issues to you, is the whole agreement about this booking. It replaces earlier discussions. It does not take away rights you have under BC law.
Changes. A change to this agreement is valid if both of us confirm it in writing, including by email or through the client portal.
Severability. If a court finds that part of this agreement cannot be enforced, the rest stays in effect, and that part is applied as far as the law allows.
Assistants and transfer. SS8 may use a trusted assistant, editor or second photographer. SS8 remains responsible to you for the work, and each of them is bound to keep your information private and to give SS8 the rights needed to deliver your licence. You may not transfer this agreement to someone else without SS8's written agreement. SS8 may transfer it only to a successor of the business that takes on the same terms.
